Repairs and Warranty

Flyfish Europe AS (“FFE”) provides commercial warranty service for selected products distributed by FFE in Europe. A commercial warranty is a voluntary commitment provided in addition to the consumer’s statutory rights.

YOUR STATUTORY CONSUMER RIGHTS
Consumers have statutory rights in relation to the conformity of goods under the mandatory consumer protection laws applicable in the country of purchase.
These statutory rights apply independently of any commercial warranty and are not limited, excluded or replaced by the terms of this commercial warranty.
If a product does not conform to the sales contract, the consumer should normally contact the retailer from which the product was purchased regarding any statutory claim.
The duration and scope of statutory consumer rights vary between European countries. Nothing on this website is intended to state or imply that the statutory rights of consumers are limited to the duration of the commercial warranty described below.

OUR COMMERCIAL WARRANTY
Where FFE provides a commercial warranty for a product, the warranty covers the defects and for the period expressly stated in the applicable brand warranty.
The commercial warranty applies to defects in materials and workmanship, subject to the specific terms and exclusions applicable to the relevant product.
A commercial warranty does not guarantee that a product will remain free from wear, damage or deterioration for the duration of its useful service life.
Where a product is covered by a commercial warranty, FFE will assess the reported problem and determine whether it falls within the scope of that warranty.
Where a covered defect is confirmed, FFE may, subject to applicable law and the terms of the applicable commercial warranty:

• repair the product;
• replace the affected component or product; or
• provide another appropriate commercial warranty remedy.

The appropriate remedy under a commercial warranty will depend on the nature of the defect, the condition of the product, availability of parts or replacement products, and whether repair is reasonably practicable.
A commercial warranty does not create an automatic right to a replacement product unless the applicable warranty expressly provides otherwise.

WHAT IS GENERALLY NOT COVERED
Unless otherwise stated in a specific brand warranty, commercial warranties do not cover:
• normal wear and tear;
• ordinary deterioration resulting from age or use;
• accidental damage;
• damage caused by misuse, abuse or use outside the intended purpose of the product;
• damage caused by improper care, cleaning, maintenance or storage;
• damage caused by exposure to chemicals or substances not intended for use with the product;
• damage caused by unauthorized modifications or repairs where the modification or repair has caused or contributed to the reported problem or prevents reasonable assessment or repair;
• cosmetic deterioration that does not affect the functionality of the product; or
• products or components that have reached the end of their reasonable useful service life.

The fact that a product can no longer reasonably be repaired does not in itself mean that the product had a manufacturing defect.

PRODUCT CONDITION AND ASSESSMENT
All products submitted for commercial warranty service are subject to inspection.
FFE may decline commercial warranty service where the condition of the product makes reasonable inspection or repair impossible.
Products submitted for service should be clean and dry and should be returned in a condition that allows the reported problem to be assessed.
In particular, products affected by mold, mildew, biological contamination or other conditions that may present a health or safety concern may be refused for service or returned without service.

UNAUTHORIZED REPAIRS AND MODIFICATIONS
Unauthorized repairs or modifications do not automatically invalidate a commercial warranty.
However, they may affect eligibility for commercial warranty service where they have caused or contributed to the reported defect or prevent FFE from reasonably assessing or repairing the product.

PROOF OF PURCHASE
Proof of purchase may be required to establish the customer’s statutory consumer rights, including the date and place of purchase.
The customer does not necessarily have to provide the original sales receipt where the purchase can reasonably be established by other evidence, such as an invoice, order confirmation, bank or credit card transaction record, or other documentation that reasonably establishes the purchase.
FFE may require reasonable evidence of purchase before processing a statutory consumer claim or a claim under the FFE commercial warranty.
Where mandatory national law provides the consumer with rights or remedies that are more favorable than those described in this commercial warranty, those mandatory rights remain applicable.

ORIGINAL PURCHASER
Where a specific brand warranty states that it applies to the original retail purchaser, this refers to the commercial warranty only.
Any mandatory statutory rights that apply to a subsequent purchaser or other consumer under applicable national law remain unaffected.

WARRANTY SERVICE
Unless otherwise agreed by FFE, products should be returned through the authorized dealer from which they were purchased.
The dealer will assist with submitting the product to FFE or the relevant warranty service provider.
FFE may require reasonable information about the product, the reported problem, date of purchase and circumstances in which the problem occurred.

COMMERCIAL WARRANTY AND STATUTORY RIGHTS ARE SEPARATE
The commercial warranty described on this website is separate from the consumer’s statutory rights against the seller.
Nothing in these terms is intended to restrict, exclude or reduce those statutory rights.

ADVERTISING AND WARRANTY INFORMATION
The commercial warranty is provided on the terms stated in the applicable warranty statement and associated warranty advertising.
FFE will endeavor to ensure that all warranty-related advertising and information accurately reflected applicable warranty terms.
If a specific brand warranty provides more favorable terms than this general framework, the more favorable brand-specific terms shall apply.
